Falmouth's Firetower Wind

The Enterprise article “Building Commissioner Says Wind 2 Not Abandoned” last Friday leaves me confused.  When I filed my zoning enforcement request, Building Commissioner Palmer agreed with me that Wind 1 didn’t have a special permit and thus, was non-conforming with the zoning bylaw and ordered its dismantling and removal.

In the case of Wind 2 response to Mr. Funfar, the building commissioner cited a Mass General Law that gives enforcement immunity to structures having a building permit and further noted that if the enforcement request came after the 6 year limit, enforcement action was forfeited.   Mr. Funfar’s Wind 2’s request for removal was denied.

Oddly, in the case of Wind 1, my zoning enforcement request in December 2017 was also filed after the six year limit cited by the building commissioner.  Wind 1 had a building permit (2009) but still, Palmer’s determination was that Wind 1…
